Terms and Conditions

Welcome to Safi -Rides, a Kenyan ridesharing platform. These Terms and Condition govern your use of our mobile application, website and related services (collectively, the Services). By accessing or using the Services, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our Services.

1.     Introduction

Safi -Rides provides a platform connecting riders with independent drivers for transportation services in Kenya. These Terms and Conditions apply to all users, including riders, drivers and visitors. Additional Terms may apply to drivers under separate agreement.

Our Services comply with the Customer Protection Act, 2012, Data Protection Act, 2019, and regulations by the National Transport and Safety Authority (NTSA). We adhere to all applicable Kenyan laws. Please review our Privacy Policy for details on data handling practices.

2.     Eligibility

To use our Services, you must:

  • Be at least 18 years of
  • Have the legal capacity to enter into contracts in Kenya
  • Provide accurate and complete information during registration
  • Not prohibited from using ridesharing services under Kenyan

We reserve the rights to suspend or terminate accounts that violate these requirements.

3.     Services

Safi -Rides Offers the following:

  • Ride-Hailing: Book rides with licensed drivers via our mobile
  • Real-Time Tracking: Monitor your ride’s
  • Payment Processing: Pay securely via M-Pesa or Card through third party processors
  • Safety Features: Drivers background checks, Ride Check alerts, and 24/7 customer

Safi Rides operates as a technology platform, not a transportation provider. Drivers are independent contractors, not employees of Safi Rides.

4.     User Conduct

You agree to:

  • Use the Services lawfully and respectfully

 

  • Refrain from harassment, violence, or
  • Avoid damaging or misusing drivers’
  • Provide accurate payment information
  • Not use the services for illegal activities, such as transporting

Violations may result in account suspension, legal action, or reporting to relevant authorities.

5.     Payments

  • Rider payments

Fares are calculated based on distance, time and demand. You agree to pay all applicable fares, taxes and fees displayed in the application. Payments are processed via M-Pesa or card and are non-refundable except as outlined in section 6.

5.2 Drivers Payments

Drivers receive payments in accordance with our Drivers agreement, less a 15% commission and applicable fees.

5.3 Promotions

Discounts or Promotional codes are subject to Terms disclosed at the time of use and may be withdrawn at our discretion.

6.     Cancellation and Refunds 6.1Cancellations

Riders may cancel rides within 5 minutes of booking without charge. A cancellation fee may apply if the driver has started the trip after this period.

6.2Refunds

Refunds for overcharges or services issues will be processed within 3 business days, subject to review. Contact us for refund requests.

6.3Driver Cancellations

If a driver cancels, you may be matched with another driver or offered a refund.

7.     Limitation of Liability

To the extent permitted by Kenyan law:

  • Safi -Rides is not liable for damages, injuries, or losses caused by drivers, riders, or third parties during rides.
  • We are not responsible for service interruptions due to technical issues, force majeure, or NTSA regulations.
  • Our liability for any claim is limited to the fare paid for the affected ride

 

  • You assume the risks associated with using ridesharing services, including vehicle accidents or personal safety.

 

8.     Termination

We may suspend or terminate your account for;

  • Violating these Terms and Conditions or applicable
  • Engaging in fraudulent or harmful behavior
  • Failing to pay the outstanding

You may deactivate your account by contacting us. Upon termination, you remain liable for any outstanding payments.

9.     Dispute Resolution

  • Information Resolution

We aim to resolve disputes within 14 days.

  • Governing Law

These Terms and Conditions are governed by the laws of Kenya.

  • Arbitration

Disputes not resolved informally shall be settled by arbitration in Nairobi under the Arbitration Act, 1995. The arbitrator’s decision is final and binding. You may seek redress through the Kenya Consumer Protection Agency or courts if required by law.

10. Changes to Terms

We may update these Terms and Conditions to reflect changes in our Services or legal requirements. We will notify you via email or the application at least 7 days before changes take effect. Continued use of the Services constitutes acceptance of the updated Terms and Conditions.
